Effective Date: October 11, 2025

These Terms and Conditions ("Terms") govern your use of the website Adsonicy.com and the mobile automotive customization and installation services provided by Adsonicy Mobile Customs ("Company," "we," "us," or "our"). By booking, scheduling, or receiving any service from us, you agree to be bound by these Terms.

1. Acceptance of Terms

1.1. Agreement: By engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our services

1.2. Capacity: You represent that you are at least 18 years of age and have the legal capacity to enter into this agreement.

2. Service Booking, Pricing, and Payment

2.1. Quoted Price vs. Final Price: All prices provided (online, via email, or over the phone) are estimates only, based on the information provided by the Customer. The final price may be adjusted upon in-person inspection of the vehicle and the service location by the Adsonicy Mobile Customs technician.

2.2. Surcharges: The Company reserves the right to impose surcharges for: Excessive Vehicle Condition: Vehicles requiring substantially more work than anticipated due to neglect, non-standard existing modifications, or difficulty of access. Unforeseen Work: Additional labor or parts required to complete the installation that was not foreseeable from the initial quote (e.g., hidden rust, stripped bolts, incompatible components). * Distance/Location: Services scheduled outside of our standard, advertised mobile service area.

2.3. Payment: Full payment is due immediately upon completion of the service and prior to the vehicle being released back into the Customer’s possession. We accept cash, major credit/debit cards, and approved digital payment methods.

2.4. Refusal to Pay: Failure or refusal to pay the full, agreed-upon service cost upon completion constitutes a breach of this contract and may void any service guarantee or warranty offered by the Company.

3. Customer Responsibilities and Site Requirements

3.1. Vehicle Authorization: You warrant that you are the legal owner of the vehicle or have the express permission from the owner to authorize the services and modifications requested.

3.2. Site Safety and Access: You are responsible for providing a safe, flat, and legal location for the technician to perform the services. The location must: Be free from traffic and other safety hazards. Provide clear and reasonable access to the vehicle. Comply with all local laws, ordinances, and property regulations (e.g., HOA rules). Provide shelter or cover for certain services (e.g., paint, wraps, and certain coatings) if specified in the quote or required by weather conditions.

3.3. Utilities: The Company typically carries its own power/water supply, but in the event of equipment failure, you agree to provide reasonable access to standard household power (120V) and/or water source, if requested by the technician.

3.4. Personal Property: You must remove all personal belongings, valuables, money, and other significant items from the vehicle prior to the start of service. Adsonicy Mobile Customs is not liable for the loss of, or damage to, any items left inside the vehicle.

3.5. Vehicle Condition Disclosure: You must disclose any known pre-existing mechanical, electrical, or cosmetic issues (e.g., faulty electrical systems, paint damage, aftermarket wiring) that may affect the service outcome. Failure to disclose such issues may void the service guarantee.

4. Cancellation and Rescheduling Policy

4.1. Customer Cancellation/Rescheduling: We require 24 hours' notice for any cancellation or rescheduling request. * Failure to Provide Notice: Cancellations made with less than 24 hours' notice, or instances where the technician arrives and the vehicle is not present or accessible (a "no-show"), will result in a cancellation fee equal to the initial deposit or 25% of the total service cost, whichever is greater.

4.2. Company Cancellation/Rescheduling: Adsonicy Mobile Customs reserves the right to alter or cancel a booking at any time due to: Inclement Weather: Conditions (rain, snow, extreme heat/cold) that prevent the safe or effective completion of the service. Technician/Equipment Issues: Staffing levels, equipment failure, or unforeseen delays. * Unsafe Location: The location provided does not meet the safety or access requirements in Section 3.2.

The Company will notify the Customer as soon as possible and work to promptly reschedule the service without penalty to the Customer.

5. Pre-Existing Damage and Damage Liability

5.1. Pre-Existing Damage: The technician will perform a brief inspection and may take photos or video of the vehicle before commencing any work to document pre-existing damage (e.g., paint chips, scratches, electrical faults). By agreeing to the service, you acknowledge that Adsonicy Mobile Customs is not liable for any pre-existing conditions.

5.2. Damage Limitation: While all due care and professional skill will be exercised, you agree that Adsonicy Mobile Customs’ liability for any damage directly caused by the negligence of our technicians during the service is limited to the cost of repairing or replacing the damaged component, up to the total dollar amount paid by you for the specific service rendered.

6. Service Guarantee and Warranty

6.1. Workmanship Guarantee: We guarantee our labor and installation services for a period of 30 days from the date of service ("Guarantee Period"). If you find probable and clear cause to believe the service technician did not fulfill the package as ordered or the craftsmanship is poor, you must notify us in writing (support@adsonicy.com) within the Guarantee Period. The Company will, at its sole discretion, re-perform the unsatisfactory portion of the service free of charge. This is the sole remedy for defective workmanship.

6.2. Parts Warranty: Any parts or materials installed by Adsonicy Mobile Customs are covered solely by the original manufacturer’s warranty, if any. The Company makes no additional warranty on parts, whether express or implied.

6.3. Voiding the Guarantee: The Service Guarantee and any implied warranties are immediately void if: The vehicle is cleaned, repaired, or modified by the Customer or another party after our service without the prior written authorization of Adsonicy Mobile Customs. The vehicle is used for racing, off-roading, or any purpose beyond normal, intended street use.

6.4. Manufacturer’s Warranty: You acknowledge that the installation of aftermarket parts and modifications may affect or void your vehicle’s original manufacturer or dealer warranty in whole or in part. Adsonicy Mobile Customs takes no responsibility and accepts no liability for the status or enforcement of your manufacturer’s warranty.

7. Intellectual Property

7.1. Use of Media: You grant Adsonicy Mobile Customs and its technicians the irrevocable right to take photographs and/or videos of your vehicle before, during, and after the service for the purpose of internal training, marketing, advertising, and publication on our website or social media. Your Personal Information (e.g., license plate number) will be obscured or not displayed.

7.2. Ownership: All content on Adsonicy.com, including text, graphics, logos, and service marks, is the property of Adsonicy Mobile Customs and is protected by copyright and intellectual property laws.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ADSONICY MOBILE CUSTOMS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, LOST BUSINESS, OR DAMAGE TO A VEHICLE NOT DIRECTLY RESULTING FROM OUR NEGLIGENCE, REGARDLESS OF THE CAUSE OF ACTION.

ADSONICY MOBILE CUSTOMS' TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO ADSONICY MOBILE CUSTOMS FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
